Still Got It

Version 1 · Effective 28 Oct 2026

Still Got It – Terms of Service

The short version

1. Introduction

Still Got It is operated by State Machines Limited (a New Zealand company; "we", "us" or "our"). Still Got It is spaced retrieval practice for your class, available at stillgotit.school and through related applications and services (collectively, the "Service").

These Terms of Service (the "Terms"), together with our Privacy Policy, govern your access to and use of Still Got It. By using Still Got It, you agree to be bound by these Terms. If you do not agree, you must not use Still Got It.

These Terms are between you and us, whether you signed up yourself or your access was arranged for you by your school or another organisation.

You must be at least 18 years old to use Still Got It. It is a tool for teachers, and accounts are for adults only.

2. Accounts

2.1 Creating an account

You need an account to use Still Got It. We ask for a display name and an email address, and either a password or a Google account to sign in with. You are responsible for keeping your account secure and for everything that happens under it. You must not share your login details with anyone else.

If you become aware of any unauthorised access to your account, please contact us at [email protected].

2.2 Signing in with Google

You can sign in with a Google account instead of using a password. We ask Google only for your name, your email address, and confirmation that the address belongs to you. We do not ask for access to anything else in your Google account, and we cannot see your mail, your files, or your contacts.

If the address on your Google account matches an account that already exists on Still Got It, signing in with Google signs you in to that existing account rather than creating a second one.

2.3 When signing in with Google replaces a password

If an account already exists for your address, has a password, and that address had never been confirmed, then signing in with Google removes the password and signs out any existing sessions on that account. You can set a new password afterwards if you want one, or carry on using Google alone.

This protects you in the case where somebody else signed up using your address before you did.

2.4 Age

By creating an account you confirm that you are 18 or over.

2.5 Accuracy of information

Any information you give us must be accurate and truthful. You must not impersonate anyone else or provide false information.

3. No pupil data

Pupils do not have accounts and cannot sign in, and grading is recorded for a class as a whole rather than for individual pupils.

You must not enter anything that identifies a pupil — not in a class name, a concept, a problem, a curriculum, or the notes you type when asking for problems to be generated. You must not use Still Got It to keep a record about an individual pupil.

If we become aware that information identifying a pupil has been entered, we may remove it.

4. Your content

4.1 What is yours

The classes, curricula, concepts and problems you create, and the grades you record, are yours (your "Content"). We do not claim ownership of them. This includes problems generated for you by AI, as described in section 6.

4.2 The permission you give us

You grant us a non-exclusive, worldwide, royalty-free licence to store, copy, back up, and display your Content, and to make the changes of format needed to show it on a screen or a projector. This licence is for running and improving the Service, as described in 4.6. We do not sell your Content.

4.3 Sharing with other teachers

When you share a curriculum, or add another teacher to a class, you grant that teacher a licence to use the Content you have shared within the Service, for teaching their own classes.

4.4 Sharing outlasts your account

If you stop using Still Got It, delete your account, or remove something you had shared, the teachers you already shared it with keep the licence you gave them.

4.5 What you promise us about your Content

You confirm that:

4.6 Improving the Service

We may use your Content, and information about how you use the Service, to understand how Still Got It is working and to make it better.

We will not share either beyond the service providers we need to run the Service, who are listed in our Privacy Policy. We do not sell your Content, and we do not pass it to anyone else for their own purposes.

5. Our content

Still Got It itself — the software, the design, and the ready-made curricula and concepts we supply — is owned by State Machines Limited or its licensors, and is protected by copyright and other intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable licence to use the Service for teaching, including as part of paid tuition. You may not resell or sublicence access to Still Got It itself as a product or service. This licence ends when your account ends, but it does not affect the licences other teachers hold under section 4.4.

You must not copy, reproduce, modify, distribute, reverse engineer, or create derivative works from our content without our prior written consent.

We may add, change, or remove features and content at any time without notice.

6. Problems generated by AI

When you ask Still Got It for problems on a concept, your request is sent to a third-party AI model, which writes them. Generated problems are added to your concept only after you approve them.

7. Prohibited conduct

You must not:

8. Suspension and termination

We may suspend or end your access at any time if we reasonably believe you have breached these Terms, if it is necessary to protect the Service or other users, or if the Service is at risk for any reason including external security events. Where practicable, we will give you advance notice.

You may ask us to delete your account at any time by emailing [email protected]. Our Privacy Policy describes what happens to your data. Content you have shared with other teachers remains available to them, as set out in section 4.4.

9. Fees

Still Got It is currently free to use. We may introduce paid features, or subscriptions for schools, in the future. If we do, we will give notice and updated terms will apply to those paid features.

10. Disclaimers and limitation of liability

10.1 Service provided "as is"

Still Got It is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we make no warranties or representations — express or implied — about the accuracy, reliability, fitness for purpose, or uninterrupted availability of the Service.

Where any condition or warranty is implied by law and cannot be excluded, our liability for any breach of it is limited as set out in clause 10.3.

10.2 Consumer Guarantees Act

Nothing in these Terms limits any rights you may have under the Consumer Guarantees Act 1993 that cannot be excluded by law. However, if you are using Still Got It in trade (for example, as a school or organisation accessing the Service for educational delivery), you agree that the Consumer Guarantees Act 1993 does not apply to that use, and you contract out of sections 9, 12A, 13, and 14(1) of the Fair Trading Act 1986.

10.3 Limitation of liability

To the maximum extent permitted by law, our total liability to you for any loss or damage arising out of or in connection with your use of Still Got It — whether in contract, tort, or otherwise — is limited to NZ$100. We will not be liable for any indirect, consequential, or special loss or damage.

10.4 Indemnity

You agree to indemnify and hold harmless State Machines Limited and its officers, employees, and contractors against any claims, losses, or damages arising from your breach of these Terms or misuse of Still Got It.

11. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will notify you — by email if we hold your address, or by a prominent notice in the app — and will endeavour to give reasonable notice before changes take effect. Your continued use of Still Got It after notification constitutes your acceptance of the updated Terms. If you do not agree, you must stop using Still Got It.

12. General

12.1 Privacy

We handle your personal information in accordance with our Privacy Policy.

12.2 Governing law and jurisdiction

These Terms are governed by the laws of New Zealand. You submit to the exclusive jurisdiction of the New Zealand courts for all matters relating to these Terms.

12.3 Entire agreement

These Terms, together with our Privacy Policy, are the entire agreement between you and State Machines Limited relating to Still Got It, and replace any prior agreements or understandings.

12.4 Severability

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be severed, and the remaining provisions continue in full force.

12.5 No waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.

12.6 Third party rights

No person who is not a party to these Terms has any right to enforce any provision of these Terms.

12.7 Force majeure

We are not liable for any failure to perform our obligations under these Terms where that failure is caused by circumstances outside our reasonable control, including natural disasters, government action, or internet service disruptions.

12.8 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations — including to a successor in the event of a sale, merger, or acquisition of Still Got It or State Machines Limited — without your consent. If we do so, we will notify you, and any successor will be bound by these Terms and our Privacy Policy.
